These Terms of Service ("TOS") govern your access to and use of the hostbillapp.com website (“Website”) owned and managed by HostBill, the services (“Services”), and software (“Software”) provided, managed and made available to you by HostBill.
By accessing the website at hostbillapp.com and using Software and Services provided by HostBill, you are agreeing to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the website, services and software.
The terms for accessing, delivery and using the Software, the rights and obligations of the Licensor and the Licensee are specified in the License Agreement ("The Agreement") document. The use of other Services may be specified in separate documents, provided to the Customer at order time. By using the Software or Services you are agreeing to be bound by the Agreement. The Software or Services are warranted, if at all, only according to the terms of the Agreement. All other warranties are disclaimed as set forth herein.
The Software and the Services provided by HostBill are made available solely for use by end users according to the Agreement. Without limiting the foregoing, the user is expressly prohibited by law from decompiling, reverse engineering, disassembling, modifying, leasing, reproducing, allowing the use of, distributing, producing derived works from the Software and Services or transmitting the Software/Services by means of a network, unless the Agreement states otherwise. Any of such actions may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
All fees specified in the order page shall be prepaid in advance based on a pro-forma invoice issued by HostBill. All payments shall be made within 30 days after the receipt of the applicable pro-forma invoice otherwise the order is cancelled. The payment should be made using one of the payment methods accepted by HostBill: credit card or PayPal or wire transfer. After successful payment Customer shall receive Final VAT Invoice by email within 6 business days. In case the payment order cannot be carried out, Customer shall be informed of this by email. HostBill has the right to refuse access to the Software or Services until the entire outstanding amount has been received. HostBill cannot be made liable for any damage caused to Customer by said refusal of access.
All amounts are payable in US Dollars unless specified otherwise in an orderpage. Unless otherwise stated, the fees do not include any taxes. If HostBill has a legal obligation to pay or collect taxes for which Customer is responsible, the appropriate amount shall be invoiced to and paid by the Customer, unless the Customer provides HostBill with a valid tax exemption certificate authorised by the appropriate taxing authority.
If for any reason,within the 30 days after you purchased HostBill License, you will be unsatisfied with HostBill or its components including: Order Pages, Plugins, Modules, or Clientarea Themes, you can claim a full refund as described below.
The 30 days Money Back Guarantee applies to new customers and license/components cost only. Services like custom development, installation, migration service are non-refundable. 30 days Money Back Guarantee starts from initial purchase date and it cannot be extended by subsequent components/license purchases. Refund can be claimed within HostBill client area. Refunds are issued within 7 days from request.
The 30 days Money Back Guarantee does not apply to "Developer" modules versions.
HostBill provides standard technical support services relating to the Software and Services to registered users providing that the users of the Software or Services are current with support fees relating to the Software or the Service. The support can be obtained via HostBill internal ticketing system, the contact form on the Website, ‘Report a bug’ feature on the website or via email. We will make our best effort to reply to questions adequately and within a reasonable time. Website visitors may contact HostBill using a contact form on the Website.
We do not guarantee that the access to the Website, or any content on it, will be always available or uninterrupted. The Website may be changed, suspended, discontinued in whole or in parts without notice. HostBill is not liable for Website unavailability or for any technical problems encountered in access to the Website or in downloading or attempting to download any content from the Website, regardless of whether the technical problem is caused by the negligence of HostBill or others.
HostBill is the exclusive owner of all intellectual property rights in or in connection with the the Website and in the material published on it except from trademarks and trade names of third parties that appear of the website which are the property of their respective owners.
The Website visitors are allowed to print out or store electronically one copy of any page and its elements of our Website for personal, non-commercial use. Any copies of the Website, whether digital or printed must not be modified. The content from the Website may not be used on any other website or print out material without acknowledging the original source. The visual elements such as photographs and illustrations may not be used separately without any accompanying text. It is prohibited to use any part of the Website, including but not limited to text content, visual design elements or any portion of HTML/CSS for business purposes without obtaining written permission from HostBill.
You agree to indemnify, release, defend and hold harmless HostBill, its officers, affiliates, directors, employees, consultants, agents, suppliers and resellers from any and all liability, claims, actions, loss, harm, damage, injury, cost or expense (including, but not limited to, attorneys' fees) in any way arising from or related to or in connection with your access to or use of this Website and the Software.
You agree that these Terms of Service will be governed and interpreted in accordance with the laws of Poland and the European Union. Any dispute arising from or relating to the subject matter of this Terms of Service shall be finally settled by courts located in Poland.
You agree that HostBill may provide you with notices, including those relating to changes to the Terms of Service by Email and/or postings on our systems and services.
By providing HostBill with any feedback, comments or suggestions regarding the website, software and and services, you hereby assign to HostBill all rights to the feedback and agree that Hostbill shall have the right to use such feedback and related information in any manner it deems appropriate.
HostBill may modify these Terms of Service at any time by posting a notice or by sending a notice via email. Customers shall be responsible for reviewing and becoming familiar with any such modifications. The use of the Website and Services following such notification constitutes the acceptance of the terms and conditions of these Terms of Service as modified. If at any time Customers do not agree to these terms and conditions, they must terminate your use of the Website or Services.
